Illegal Probation Sentence Vacated

A client had originally been charged with duplicitous counts of child pornography, and sentenced to both prison and probation. After he got out of prison, he asked the court to vacate one of his duplicitous counts. Rather than terminating his sentence altogether, the judge instead merged his first and second charges into one, and sentenced him to another 10 years of probation without credit, negating the time he had already served on probation. His attorney at the time did not spot the error during the hearing. The client then came to us, requesting that we look at the validity of his probation sentence.

Result:

Our office reviewed the facts surrounding his probation, and determined that he was serving an illegal sentence. Because our client had already completed his prison sentence, the Court was not allowed to merge his first and second counts, which  violated his Constitutional right against double jeopardy. Attorney Regan submitted a motion to the court which was allowed, and our client's probation sentence was vacated.
