The Massachusetts Supreme Judicial Court recently ruled in Commonwealth v. Demos D. that police may order a passenger to exit a vehicle under the community caretaking doctrine. In this case, the passenger was a 16-year-old runaway. This doctrine allows officers to act to ensure public safety or individual well-being, separate from criminal investigation.
